General terms and conditions
Article 1 - APPLICABLE RULES
This contract is subject to the legal status applicable to tourist residences.
The resident - occupant - may not have recourse to the legal provisions applicable in relation to residential tenancies, including with regard to security of tenure.
Any domicile in the Residence, whether private or professional, is prohibited.
Article 2 - RESERVATION
The reservation of an apartment in the Résidence La Réserve is only valid after acceptance of the customer’s reservation by La Réserve. The confirmation of the customer’s reservation by La Réserve remains at the discretion of the Résidence management.
In addition, the booking must be firm, be guaranteed by a valid credit card issued by a reputable institution*, or have been subject to an advance credit agreement with La Réserve, or be followed by the payment of a deposit.
This deposit must correspond to one night for stays of less than 7 nights, two nights for stays of 7 to 29 nights and three nights for longer stays.
Reservations accepted by La Réserve that are the subject of a deposit (or guarantee) will be held until five days before the arrival date. In the absence of payment of this deposit no later than five days before the planned date of arrival, the booking will be automatically cancelled.
Bookings made less than five days before the scheduled date of arrival must necessarily be guaranteed by a valid credit card issued by a reputable institution*.
Group bookings (i.e. bookings of more than 10 rooms made by a single organisation) are subject to the group terms and conditions.
Article 3 - CONDITIONS OF PAYMENT
Invoices must be paid immediately on presentation. On the day customers arrive, they will be charged by La Réserve for their entire stay, with the exception of stays of more than 15 days, in which case invoices will be issued and presented every 15 days.
In the event it has been agreed that a guest’s stay is to be be paid by a third party, the occupant will remain personally liable for the payment in question.
The payment of all optional services will be required on presentation of the corresponding invoice. The credit ceiling accepted by La Réserve for this type of service is €200.
La Réserve will be entitled to a monthly interest of 1.5% on any amount unpaid by the settlement date.
Article 4 – PRICE
Prices are given in local currency and only cover the provision of an apartment. They do not include any taxes (local, tourist tax, etc...). Optional services are not included in the price.
Rates are subject to change during the year.
Article 5 - CHANGES TO RESERVATION OR DURATION OF STAY
Subject to availability and at the discretion of the management, the duration of stay may be extended, without any obligation to maintain the same apartment or the same rate.
In the event an extension of stay is accepted and a new rate is applied, this will be applicable from the original arrival date. In the event of early departure, the applicable price will correspond to the shortened period.
Please note that any rate changes related to an extension of stay or early departure will apply retroactively to the customer's account from the date of arrival.
Article 6 - CANCELLATIONS / NO-SHOWS
No cancellation received before noon on the day of the scheduled arrival date will be subject to a cancellation fee. Any cancellation received after noon the day of the scheduled date of arrival will be subject to a cancellation fee equal to:
One night (plus taxes) for stays of less than 7 nights
Two nights (plus taxes) for stays of 7 to 29 nights
Three nights (plus taxes) for stays of 30 or more nights.
The failure to arrive (of a reservation) in the absence of a cancellation will be deemed be a “no-show” and will be subject to the aforementioned cancellation fee.
The effective date of a written cancellation will be the date of its receipt by the Résidence.
Article 7 - DEPOSIT GUARANTEE
A security deposit will be held during the whole stay. The amount will depend on the size of the apartment rented and set out in the contract. It will be returned after payment of all sums due and upon completion of the departure inventory.
Article 8 – OBLIGATIONS OF GUESTS
The apartment will be made available to guests in a good state of repair. Guests will use the premises and their facilities with all reasonable care.
An inventory can be found in each apartment. Guests must verify its accuracy upon arrival and report any anomaly, or missing or damaged items, to the reception within four hours of arrival. Upon the guest’s departure, the inventory and state of cleanliness of the apartment will be checked by La Réserve and any item missing from the inventory or damage caused to the apartment will be billed to the guest.
La Résidence reserves the right to enter the rented premises for maintenance or safety purposes.
Article 9 – RESPONSIBILITY
La Réserve cannot be held liable in case of theft or damages to personal belongings in the apartments, the common areas, car parks or other areas of the Résidence. As this contract is subject to the legal status applicable to tourist residences, the provisions of Articles 1952 and following of the French Civil Code concerning hoteliers do not apply.
Article 10 - TERMINATION - SANCTIONS
The contract will be terminated by right, immediately and without formalities in the event of non-performance by guests of any of their obligations, of inappropriate behaviour likely to disturb the stay of other occupants and/or breach of the internal rules. Guests must immediately leave the premises and may be removed if necessary with the assistance of the police.
